Welcome to Kadrik, an Instagram photo preparation tool operated by WebProd. These Terms of Service govern your use of our web application at kadrik.app, including our image editing features and AI-powered description generation service. By accessing or using Kadrik, you agree to be bound by these terms.
1. Acceptance of Terms
By creating an account or using Kadrik, you confirm that you are at least 18 years old and agree to these Terms of Service. If you do not agree with any part of these terms, you must discontinue use of the service immediately. Your continued use of Kadrik constitutes ongoing acceptance of these terms and any future updates.
2. Service Description
Kadrik is a web application for preparing photos for Instagram publication. The Service includes image cropping and formatting tools, as well as AI description generation using tokens. Image processing is performed locally in your browser.
3. Registration and Accounts
Access to the full functionality of the Service requires authorization through Google OAuth. You are responsible for maintaining the confidentiality of your Google account credentials and all activities performed in the Service under your account. You agree to immediately notify us of any unauthorized use of your account.
4. Token System and Payments
Kadrik uses a token-based system where one token equals one AI description generation. Tokens are purchased through YooKassa and are non-refundable once used. Unused tokens remain in your account indefinitely but cannot be transferred or exchanged for cash. WebProd reserves the right to modify token pricing with reasonable notice to users.
5. User Responsibilities
You agree to use the Service only for lawful purposes and in accordance with these Terms. It is prohibited to: upload content that violates third-party rights or applicable laws; use the Service to distribute malicious software; attempt unauthorized access to Service systems; use automated means for mass access to the Service.
6. Prohibited Uses
It is strictly prohibited to use the Service to process or distribute: pornographic materials involving minors; content promoting violence, terrorism, or extremism; materials infringing copyrights or trademarks; fraudulent or misleading content. Violations will result in immediate account termination.
7. Intellectual Property
You retain full ownership of all images you upload to Kadrik. AI-generated descriptions are provided for your use but WebProd makes no claims regarding their originality or suitability for any purpose. The Kadrik application, including its design, code, and branding, remains the exclusive property of WebProd.
8. User Content
You retain all rights to images you upload. Kadrik does not claim ownership of your content. Image processing is performed locally in your browser, and we do not store your photos on our servers. You warrant that you have all necessary rights to the content you upload.
9. Disclaimer of Warranties
Kadrik is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. WebProd does not guarantee uninterrupted access, error-free operation, or that AI-generated content will meet your specific requirements.
10. Limitation of Liability
We are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including lost profits, data loss, or reputational damage. Our total liability shall not exceed the amount you paid for tokens in the preceding twelve months.
11. Indemnification
You agree to indemnify and hold harmless WebProd, its employees, and partners from any claims, damages, and expenses (including legal fees) arising from your violation of these Terms, third-party rights, or applicable laws. This obligation survives termination of your use of the Service.
12. Service Availability and Changes
We strive to ensure continuous operation of the Service but do not guarantee constant availability. We reserve the right to modify, suspend, or discontinue the Service in whole or in part at any time without prior notice. We may also change token pricing with advance notice to users.
13. Termination
WebProd may suspend or terminate your account at any time for violation of these terms or for any reason at our discretion. Upon termination, your right to use Kadrik ceases immediately and any unused tokens will be forfeited. You may delete your account at any time through the application settings.
14. Governing Law
These Terms of Service shall be governed by and construed in accordance with applicable international commercial law principles. Any disputes arising from these terms shall be resolved through good-faith negotiation between the parties. Nothing in these terms limits your statutory rights as a consumer.
15. Dispute Resolution
Before resorting to legal action, the parties agree to attempt to resolve disputes through negotiation. Pre-trial dispute resolution is mandatory. We aim to respond to all complaints within 30 calendar days.
